Terms of Sale (CGV)

1. Purpose
These Terms of Sale govern subscriptions to the paid plans of the Apogia platform: the Creator, Pro and Studio plans, billed monthly or annually. The Discovery plan is free and falls within the scope of these terms only where they mention it expressly.
2. Pricing
Prices are displayed in euros and are inclusive of all taxes. Apogia reserves the right to modify prices at any time. Existing subscriptions will not be affected by price changes until their next renewal.
3. Quotas and extra hours
The service is metered in hours of VOD analysed. A 3-hour VOD uses 3 hours of quota, whether the user cuts 2 clips or 20 from it. Each paid plan includes a monthly quota of analysed hours, reset at every billing date, and a maximum duration per VOD. Those values are shown on the pricing page and in the user's billing area. Beyond the monthly quota, analysed hours are billed at €1.99 per hour started and added to the next invoice. These extra hours are capped at the monthly quota of the subscribed plan; past that cap, no new analysis can be started until the quota resets. The Discovery plan carries no extra hours: it stops at its quota. No extra hour is billed without the user's prior agreement. When an analysis goes past the remaining quota, the estimated amount is shown and the analysis only starts once the user has explicitly confirmed it. Where the duration of a file cannot be measured before the analysis, the user is told so and confirms on the same terms.
4. Payment
Payments are processed securely via Stripe. Accepted payment methods include credit cards and other methods supported by Stripe. Invoices are sent by email after each payment.
5. Subscription and renewal
Subscriptions are billed monthly or annually depending on the chosen plan. Subscriptions renew automatically at the end of each period. Users can cancel at any time from their billing settings; the service stays active until the end of the current period. A plan change within the same billing frequency takes effect immediately and is prorated on the next invoice. A change of billing frequency, in particular moving from monthly to annual, opens a new cycle immediately: the new period is charged at the time of the change and the remaining time of the current period is credited.
6. Generated content and promotional licence
Clips generated by Apogia remain the user's property. Subscribing to a paid plan carries no promotional-use authorisation: that is a separate, optional and revocable consent, described in article 6 of the Terms of Use and given from Settings → Privacy. Declining it has no effect on the price, the quotas or the features of the plan subscribed to. Apogia claims no ownership of the user's source video content. Processing is carried out for the sole purpose of providing the subscribed service. Analysis results (scores, segments, metadata) are Apogia's property and may be used in anonymised form to improve the service and for research.
7. Refund policy
In accordance with French consumer law, users have a 14-day withdrawal period from the date of subscription. Refund requests can be made by contacting our support team. No refund is available for partially used billing periods after the withdrawal period.
8. Limitation of liability
Apogia's total liability is limited to the amount paid by the user in the 12 months preceding the claim. Apogia does not guarantee specific results from the analysis and clip generation. The user acknowledges that the quality and relevance of generated clips depend on the quality of the source content and the chosen settings.
9. Governing law
These terms are governed by French law. In case of dispute, the parties shall first seek an amicable resolution. Failing that, disputes shall be submitted to the competent courts of France.
